By accessing AND/OR using this SETTRADE.COM wap pages (“this site”) and any software including but not limited to “Daytrade WE (Daytrade Wireless Edition)” (“the Software”) of SETTRADE.COM Co.Ltd., you (“you”), as a user of this site, agree to the following terms (“these terms”), which supplement the terms and conditions of any offer agreement(s) you may have with SETTRADE.COM which are applicable to you use of this site and the Software. If you do not agree with these terms, please discontinue your use of this site and the Software. These terms govern all transactions and operations between you and SETTRADE.COM in relation to the use of any software, products or other materials (collectively, the “Materials”) and services (the “Service”), content and data on this Site. These Terms shall neither exclude nor limit any of your mandatory rights provided to you by applicable laws.

1. Limitation of Liability
1.1 You agree to use the Software at your own risk and except as prohibited in the following provisions SETTRADE.COM does not warrant that this Site, Materials, Services and/or Software will be uninterrupted, timely, or error-free or meet your requirements. The Service is provided as an “as is” basis.
1.2 SETTRADE.COM is not liable for the non-availability of this Site and/or the Software caused by transmission problems. SETTRADE.COM assumes no liability for any delay, data loss or damage during the transmission from the Site to the recipient.
1.3 No warranty of any kind is made in relation to the condition, suitability, availability, accuracy, reliability, merchantability and/or non-infringement of any content of this Site, use or performance of the Software, the user's own equipment, the internet itself, and public lines and/or operator networks.
1.4 To the extent permitted by applicable law, SETTRADE.COM accepts no responsibility for any claim in contract, tort, negligence or otherwise for any 1) loss of profit, business revenue, goodwill, anticipated savings and/or data; or 2) indirect or consequential loss or damage.
1.5 You indemnify SETTRADE.COM from any claims. You agree that you use our Software “Daytrade WE” at your sole risk. Although best effort has been made, SETTRADE.COM make no warranty of any kinds. Please proceed or use Daytrade WE if you accept our terms of use as in www.settrade.com/disclaimer.

2. Important
Your use of this site and the Software will be subject to the most current versions of these Terms, Broker's Internet Trading Service Terms as well as the SETTRADE.COM Site Terms of Use posted on www.settrade.com at the time of such use. SETTRADE.COM reserves the right to change any of the above mentioned and you agree to review such changes. Continued use of this Site and transactions in relation to any Materials or Services or Software after any such changes shall constitute your consent to such changes.
2.1 This Site and the Software support only Materials and Services delivery to the mobile phone numbers of operators operating in Thailand. The mobile phone must be powered and switched on during the whole transmission and delivery. Should the recipient be outside the territory during any part of the transmission and delivery of the transaction are dependent on the nature of the particular Materials or Services, the recipient's operator's roaming agreement with the other network operators, the network coverage of the senders and recipient's operator, etc.
2.2 Availability of Materials and /or Services and/or Software may vary as informed.
2.3 By submitting an order, you give your consent to 1) that your personal information provided may be sent electronically to servers of SETTRADE.COM, be processed and be stored in the relevant databases. Further, you accept that SETTRADE.COM for performing trading related services have access to your personal data that is needed for providing the services.

3. Use of this Site
3.1 SETTRADE.COM may reasonably change, modify or withdraw access to any Materials and/or Services and/or this Site at and/or the Software any time, with or without prior notice, and without creating liability for SETTRADE.COM
3.2 You agreed to use this site and any Materials and Services and Software strictly in accordance with these Terms and SETTRADE.COM's reasonable instructions.

4. Notice Specific to Software available (“Streaming”) on this web site
4.1 Any software that is made available to download from the Services ("Software") is the copyrighted work of SETTRADE.COM and/or its suppliers.
4.2 The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
4.3 Without limiting the foregoing, copying or reproduction of the Software to any other server or location for further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the License Agreement accompanying such software.
4.4 For your convenience, SETTRADE.COM may make available as part of the services or in its software products, tools and utilities for use and/or download. SETTRADE.COM does not make any assurances with regard to the accuracy of the results or output that derives from such use of any such tools and utilities. Please respect the intellectual property rights or others when using the tools and utilities made available on the services or in SETTRADE.COM software products.
